Nuisance Abatement Board of Appeals
City Council finds that public nuisances exist in the City of York in the operation of certain buildings, structures and dwellings and the use and occupancy of property operating in flagrant and persistent violation of federal, state and local laws create a public nuisance. The persistence of such activities and violations is detrimental to the health, safety and welfare of the people of the York City.
The City issues certificates of occupancy, certificates of use and occupancy and/or tenant occupied dwelling licenses for the operation and occupation of certain buildings, structures and dwellings within the City. The issuance of such certificates and licenses are conditioned upon the property owners' continued compliance with all federal, state and local laws and the preservation and protection of the health, safety and welfare of all persons. It is the purpose of Council to authorize and empower the Code Official and the Department of Fire/Rescue Services to suspend or revoke occupancy certificates, use and occupancy certificates, and tenant occupied dwelling licenses, in accordance with applicable laws, for the existence of public nuisances.
Each violation is assigned a point value that when calculated if said points equal the point value determined to meet the qualification of a public nuisance, then a public nuisance shall be deemed to exist and the property owner will be notified. Upon notice, the above-mentioned designated officer(s) may, among other things, secure the property in order to abate the nuisance(s), or may suspend or revoke certificates and/or licenses for the operation and habitation of said dwelling.
The owner(s) of properties served with notice of determination that a public nuisance exists, may appeal to the Nuisance Abatement Board of Appeals within 10 days from thye date of said notice.
The Nuisance Abatement Board of Appeals consists of three members and two alternates all of whom are appointed by the Mayor with the advice and consent of Council. Regular members serve 3-year terms and alternates serve a 1-year term. Meetings are held on an as-needed basis.
