City Council Meeting Minutes

June 11, 2007

City Council convened in Regular Session at 1:20 p.m. on Monday, June 11, 2007, in Council Chambers, 1 Marketway West, 3rd Floor, York, PA, with the following members present: Toni Smith, Wm. Lee Smallwood, and Cameron Texter, President, with President Texter presiding. Councilpersons Musso and Washington were absent. Mayor John Brenner was not present. (Note: The meeting was to begin at 1:00 p.m. but was delayed until a quorum was established.)

The following members of the Administration were absent: Jim Gross, Director of Public Works, Kim Bracey, Director of Community Development, Matt Jackson, Director of Economic Development, Mark Whitman, Police Commissioner, John Senft, Fire Chief, and Michael O’Rourke, Business Administrator. Assistant Solicitors Don Hoyt and Shaleeta Washington were also absent.

Members of York City Council staff in attendance included: Dianna L. Thompson, City Clerk.

Special Session

President Texter announced that Council has convened in special session today to consider HARB recommendations in order to meet the requirements of the 30-day rule with regard to Council’s approval and/or denial of certificates of appropriateness. He explained that Article 1731.12(b) of the Codified Ordinances regulates that no later than thirty days after the receipt of the written recommendations of the Board of Historical Architectural Review, Council shall render its decision on approving and/or denying certificates of appropriateness. As Council’s last legislation session was held on June 5 and Council won’t reconvene again until July 17 (due to Council recess), a special meeting has been called so as not to violate the requirements of Article 1731.12(b). President Texter went on to explain that, as duly advertised, no other items would be considered during this meeting and public comment would only be received on this agenda item.

Therefore, President Texter introduced the following Resolution:

Resolution No. 94, Session 2007, A Resolution accepting the recommendations of HARB in issuing Certificates of Appropriateness for work to be covered in the applications received by Mark Simpson, Commerce Bank, for work to be done on the NE corner of N. George St. and E. Philadelphia St. (intersection); Fran Spero, York Habitat, for work to be done at 245, 247, 249 & 251 Prospect St.; United Realty & Development for work to be done at 100-102 S. Beaver St. and 110-112 W. King St.; and Randy Poe, York City Bureau of Housing Services, for work to be done at 143 S. Pershing Ave., was introduced by Texter, read at length, and on motion of Texter, seconded by Smith, Resolution No. 94 came up for discussion.

President Texter took a moment to relay that informal discussion has taken place to consider extending the HARB District to add sections of the Avenues area of the city to address satellite dishes. Councilman Smallwood suggested a joint work session be held with HARB members, Council, the Administration, the public, and other interested parties to discuss this proposed expansion.

There being no further discussion, Resolution No. 94 passed by the following vote: Yeas – Smith, Smallwood, Texter – 3; Nays – 0.
