Construction Board of Adjustment and Appeals

The Construction Board of Adjustment and Appeals consist of five members and two alternates to be appointed by the Mayor with the advice and consent of Council. In addition to the appointed members, the code official(s) or designee(s) of the Department of Economic Development and the Department of Fire/Rescue Services shall both serve as ex-officio members of the Board, but shall have no vote on any matter before the Board.

Members of the Board are chosen from individuals with knowledge and experience in technical codes, such as design professionals, contractors, or building industry representatives. One alternate member shall be from the building industry at large and one alternate member shall be from the general public. No Board member shall act in any case in which they have a personal or financial interest. Regular members serve 3 year terms and alternate members serve a 1 year term.

The Board has been granted the power to hear appeals from decisions and interpretations made by the code official(s) or designee(s) of the Department of Economic Development and the Department of Fire/Rescue Services and to consider equivalencies to the requirements of the various technical codes as adopted by the City. (For the purposes of Article 190 of the Codified Ordinances, "technical codes" means the Building Code, Fire Prevention Code, Electrical Code, Mechanical Code, Plumbing Code, and Property Maintenance Code of the City, their associated reference standards and codes, and any rules and regulations promulgated thereunder.)

The Board is charged with interpreting the building, fire, plumbing, property maintenance, electrical and mechanical codes to owners of properties in the City of York where an inspection took place or where plans are being made to build a new building or remodel an exiting one. For example, occasionally, an owner, builder or architect is not clear on what is required to meet code standards according to the inspector’s decision. This is when the Board becomes helpful in working with all parties to comply with the code or codes in question.

Meetings: Meetings are held on an as-needed basies on the 2nd and 4th Wednesday of the month at 6:30 p.m. in Council Chambers, 101 S. George St., 1st Floor, York, PA.
